Pursuant to Article 13 of Legislative Decree No. 196/2003 on the “Personal Data Protection Code”, Fiat S.p.A., Centro Ricerche Fiat S.c.p.A., CNH Italia S.p.A., Comau S.p.A., Elasis S.c.p.A., Fiat Group Automobiles S.p.A., Fiat Powertrain Technologies S.p.A., Fiat Services S.p.A., Iveco S.p.A, Magneti Marelli S.p.A., Teksid S.p.A., in the capacity of Data Controllers, each hereby inform every candidate who voluntarily supplies their personal data that:

All data freely given shall be processed exclusively for staff selection and assessment purposes;
The FIAT Group companies select staff using equal opportunity criteria and do not discriminate between candidates of either gender, in compliance with Laws 903/77 and 125/91 ;
This data shall be processed and stored with the utmost confidentiality, care and diligence in compliance with the provisions of Legislative Decree No. 196/2003 and according to the methods outlined below.

1. COLLECTION AND NATURE OF THE DATA
Data shall be collected by the compilation of the relevant form by the data subject and recording of his/her curriculum vitae.
Only general data required for processing shall be collected within the limits strictly pertinent to the obligations, tasks and purposes outlined in point 2 below.
The data subject is therefore requested not to supply personal data deemed as “sensitive” (pursuant to Article 4, para. 1, point b) of Legislative Decree No. 196/2003 which defines as sensitive any personal data that may reveal, in particular, racial or ethnic origin, religious beliefs or other beliefs of a similar nature, political opinions, membership of parties or trade unions or personal data that reveals the physical or mental health or condition or sexual life) and/or judicial ((pursuant to Article 4, paragraph 1 point e) of the above-mentioned Legislative Decree define as “judicial” any personal data that may reveal, in particular, that the data subject is under investigation for, or accused of, the commission of an offence pursuant to Articles 60 and 61 of the Italian Criminal Procedures Code).
If, however, the candidate deems it indispensable to supply sensitive data, the curriculum vitae must only be sent by normal post to the addresses given and include the relevant consent, duly dated and signed, for the processing of this data.

2. PURPOSES OF THE DATA PROCESSING Personal data shall only be processed for the purposes of staff searches, selection and assessment.

3. THE OBLIGATORY/OPTIONAL SUPPLY OF DATA
The supply of personal information by the data subject, the inclusion of his/her curriculum vitae and his/her consent to the processing of this personal data are optional: however, if consent is not given to the processing of personal data, we will not be able to carry out the relevant staff searches, selection and assessment activities.

4. SCOPE OF COMMUNICATION AND DISSEMINATION OF DATA
Your personal data may be communicated and processed by FIAT Group companies with headquarters in Italy or abroad, to Data Controllers or data processors appointed by our company or to FIAT Group companies or to third parties who, in Italy or abroad, supply specific services or carry out activities that are connected, instrumental or support the methods and purposes for which you have supplied your personal information. Moreover, your personal information, for the processing purposes outlined in this information note, may be transferred, even temporarily, outside Italy also to countries outside the EU. Your written consent is indispensable for this transfer; this is required to enable us to carry out staff searches, selection and assessment activities for FIAT Group companies with headquarters outside the EU.

5. PROCESSING METHODS AND DATA STORAGE
Data shall be processed in compliance with the provisions of Article 11 of Legislative Decree No. 196/2003. Data processing shall always be carried out using programmes strictly related to the purposes indicated above and using methods that ensure the safety and confidentiality of this data, by adopting methods that impede the alteration, cancellation, destruction and unauthorized access of the data, or processing that is not allowed or does not comply with the purposes of the data collection.
The data shall be stored in our databases for the period of time required, and no longer, to manage and monitor the search and selection process.

7. DATA SUBJECT’S RIGHTS Finally, we confirm that you can exercise your rights with the Data Controller responsible for data processing pursuant to Article 7 of Legislative Decree 196/2003 which, for your convenience, is made available here in its entirety:
The data subject also has the right to be informed of :
a) the origin of the personal data;
b) the purposes and methods of the data processing;
c) the programme used in the event of the data being processed using electronic means;
d) details identifying the Data Controller, the data processors and the designated representative pursuant to Article 5, paragraph 2; 5, para. 2);
e) the subjects or categories of subjects to whom personal information may be disclosed or who may gain knowledge thereof in their capacity as appointed representatives for the country, data processors or officers.
The data subject has the right to receive;
a) an update, rectification or, if he or she requests it, an addition to the personal data ;
b) the cancellation or change to anonymous status or a block on the data processed in breach of the law, including personal data that is not required to be stored for the purposes for which the data was initially collected or subsequently processed;
c) a declaration that the operations specified under letters a) and b) have been notified, including their contents, to the persons to whom personal data was disclosed or disseminated, except where this is impossible or implies the use of means that are clearly disproportionate to rights being protected. The person concerned has the right to object to, in total or in part:
a) the processing of his/her personal data for legitimate reasons, even if this data is relevant for the purpose for which the data was collected;
b) the processing of personal data relating to him/her for the purpose of sending advertising or direct sales material, or for carrying out market research or marketing communications.
